    Property division in New York is based on equitable distribution. The general rules is that property and assets that were acquired during the marriage are considered marital property. Separate property that is not considered marital property includes gifts from non-spouses, inheritance, and personal injury awards. Marital property may also include retirement plans such as pensions, 401(k)s, IRAs, and profit sharing plans.
